Terms of Service

Our Terms of service consists of specific rules and regulation guidelines for using our services. By purchasing or using our services you are subject to these terms, and agree that you are at least eighteen years old and have the legal ability to engage in a contract in the State of Massachusetts. Payment

As a customer, you will be billed on the first day of each billing term in US Dollars. Failure to pay within ten days of receiving an invoice leaves your account subject to a late penalty of $10.00, and also gives us the right to suspend services until you do pay. If you do not pay after 60 days, we reserve the right to terminate your account. We're not responsible for any losses or damages as a result of suspension or termination.

Refunds

If for any reason you find yourself unsatisfied with our services (within the first 30 days of ordering), just let us know and your fees will be refunded to you. Please keep in mind that this is only for new accounts, and refunds are not offered for accounts that are suspended or terminated for violating these terms. Also, we reserve the right to determine which payment method we will use to refund you.

Cancellation

You may cancel your account at any time by providing us at least forty-eight hours prior notice. You may do so by completing our cancellation form in the client area. uspension or Termination We reserve the right to suspend or terminate this agreement and all services at anytime without notice or reason. Our usual reasoning for this because of a breach in the agreement, and we usually do inform you of the reason, but we are not obligated to. We are not responsible for any loss or damages resulting from this.

Resource Usage

You are required to utilize available server resources so as to allow for reasonable performance by other customers. Because server components are shared resources, excessive consumption can interfere with the performance of other accounts. We reserve the right to suspend or terminate any account that we feel is abusing server resources. This can occur without any prior warning.

Although some of our plans offer unlimited space and bandwidth, there are some content and service restrictions in place to ensure that server resources are being used responsibly. It is your responsibility to make sure that your website is optimized and secure. What is not allowed on our servers is websites whose essential purpose is to use disk space or bandwidth. Some examples of what is not allowed can include copyrighted content that you are not the owner of, a website created to drive traffic to another website, file uploading/sharing/backup/archiving/mirroring/distribution sites, web spiders, the operation of game servers, SEO farms, banner rotation and link exchanges, pornography, and spamming or mass emailing. Keep in mind that anything not included in these terms that we feel is abusing server resources can be subject to suspension or termination.

Please understand that this does not mean your resources are limited. These types of rules are in place by every other web hosting company in the industry, and it is our goal to be completely up front about them. The main goal is to keep your legitimate website running, even if you end up on the first page of Digg.

Uptime Guarantee

Unlike most hosting companies, we offer a 99.99% uptime guarantee. Essentially, should you notice that your web site, databases, email, FTP or webmail is unusable because of a failure in our servers (other than announced scheduled maintenance or coding/configuration errors on your part) we will credit your account. For every hour that services are inaccessible we will credit you with 1 day of free hosting, up to a month free. To receive your credits, you must submit a support ticket to us within 30 days of the incident.

No Warranty

The use of our services is at the customer's sole risk. We do not warrant that our services will not be interrupted or be error-free.

Limitation of Liability

Under no circumstances are we responsible or may we be held liable for any damages or loss that that may result from the use of (or inability to use) of our services. You acknowledge that this paragraph applies to all content on all of our servers.

Indemnification

You agree that you shall defend, indemnify, save and hold us harmless from any demands, liabilities, losses, costs and claims, including attorneys' fees, against us or any of our employees, clients, officers, and agents, that may arise or result from any service provided or performed or agreed to be performed, or any product sold by you, your agents, employees or assigns. You agree to defend, indemnify and hold us harmless against liabilities arising out of an injury to person or property caused by any products sold or distributed in connection with our servers
